BOOKING TERMS AND CONDITIONS

IMPORTANT INFORMATION

Whilst we will work very closely with you to help create your USA adventure it is important to ensure that your plans remain undisturbed. To help prevent any unforeseen surprises or financial setbacks, kindly review the following information before finalising your travel arrangements with us.

    • Please check that all names in your booking are correct (names must be exactly as per passport names) prior to confirming your booking.
    • To help prevent any issues please send us a photo or copy of the personal details page of your passport prior to confirming your booking.
    • Please check that your passport is undamaged, has blank pages and remains valid for at least six months after your planned return date or you could be denied boarding.
    • Travel regulations mandated by Government may change at short notice, potentially leading to additional costs or financial loss. Consequently, any utilisation of travel services we coordinate as sales agents for our Principles is undertaken at your own risk. 
    • We recommend checking the latest government advice available at www.safetravel.govt.nz before making travel arrangements and commencing your journey.
    • If you belong to an airline, hotel, or car rental loyalty programme, please inform us before confirming your travel, preferably at the initial inquiry stage. This allows us to explore options with your preferred providers and ensure we capture your loyalty card numbers. It is important to be aware that certain promotions may occasionally not qualify for points or upgrades. 
    • Please let us know if you have any specific airline seating, baggage, meal, or assistance requirements prior to confirming your booking. However please be aware that special requests can vary depending on airport, airline, aircraft, route, and fare and are not guaranteed until check in.
    • We are not licensed to provide health, visa or insurance advice and any advice we provide is of a general nature only.
    • We strongly advise you to purchase comprehensive travel insurance at the time of booking your travel and we will discuss this with you during the trip planning process.  
    • All travellers are individually responsible for meeting all government and supplier travel requirements, including passports, visas, documentation, health, and any other requirements. 
  • There are a few things that may prevent you from travelling to the USA - such as a criminal conviction, unpaid fines or if you have a serious health problem or communicable disease.

TRAVEL USA GENERAL TERMS AND CONDITIONS

  • Scope and Agency

These terms and conditions apply to all travel services transactions with Travel USA Limited (we/us).

As travel agents, we offer for sale various products and services on behalf of airlines, transport operators, hotels and other accommodation providers, tour operators and all other principal suppliers. These are referred to in these terms and conditions as "Principal/s".  

We do not provide travel products and travel services. We act as the agent of the Principals and our services consist of arranging and co-coordinating the services offered by them. As a travel agent Travel USA Limited facilitates a direct contractual relationship between you, the customer, and each Principal. As such, your booking is subject to the Principals terms and conditions, copies of which have either been provided to you or are otherwise available on request from us.

We undertake to fulfil our role as agent for the Principals with reasonable care and skill, but we cannot and do not guarantee the performance of the functions offered by the Principal/s and we will not be liable if you suffer loss, injury, or disappointment by reason of any acts or failings, including insolvency or closure of any Principal.  In any such case your remedy will lie directly with the Principal.

  • Information Provided by Us

We have exercised reasonable care and skill to ensure that the contents of this website are correct, accurate, and up to date as at the time of publishing. This content has been taken from public sources, third party suppliers or information made available from our Suppliers including websites and brochures. This content has been provided to the best of our knowledge and to the maximum extent permitted by law we do not accept any liability for any innocent inaccuracies or misrepresentations contained in such information. 

  • Changes to travel requirements, schedules and travel services by governments or principals

Principals or Governments may make changes without or with limited notice to routes, schedules, cancel services, or change entry, visa, health, or quarantine requirement or make other decisions that impact your travel plans. If this occurs, we will work with you to minimise the impact on your travel, however we are not responsible for any losses or additional costs that arise.

  1. Travelling to the USA - Travel Insurance 

We strongly advise you to purchase comprehensive travel insurance at the time of booking your travel and we will discuss this with you during the trip planning process. 

You should ensure that the provisions of your insurance policy sufficiently address your potential needs. This includes coverage for involuntary cancellation, medical expenses resulting from sickness or injury during your travels, protection for non-refundable items, as well as coverage for loss or damage to your belongings and personal liability insurance. Additionally, you should ensure that your policy encompasses any relevant activities that you are planning such as cruises, car rental, snow-related activities, sports, adventure activities, motorcycle moped riding and other high-risk activities.

It is your responsibility to disclose any pre-existing medical conditions when purchasing travel insurance. A confidential medical assessment may need to be carried out by our insurance provider prior to confirming your coverage. Failure to disclose and complete a medical assessment with our insurance provider, for any pre-existing conditions (relating to physical and/or mental health) may result in subsequent claims against your policy being denied.

Should you choose not to accept our travel insurance proposal, we will request you to sign a waiver. By signing the waiver, you confirm that we have extended the offer of travel insurance to you, and you explicitly waive any claims against us for any potential loss or damage that may occur due to your decision to forego obtaining any or sufficient travel insurance.

Use of the travel services and any ancillary activities you take part in are at your own risk. Any recommendations or opinions we offer in respect of the services are opinion only and not advice suitable for your personal circumstances. We assume no responsibility for the outcomes of your decision to use the travel services or to take part in any ancillary activities.

  • Travelling to the USA - Passports & Visa Requirements

All travellers are individually responsible for meeting all government and supplier travel requirements, including passports, visas, documentation, health, and any other requirements. Outside of providing general information available from public sources we do not provide health, insurance, visa, or immigration advice and do not accept any liability in relation to such. We will proceed on the basis that all travellers on a booking made with us have valid passports, visas and re-entry visas unless advised otherwise.

New Zealand passport holders will not be able to enter the United States without a valid Electronic System for Travel Authorisation (ESTA) or Visa. New Zealand nationals travelling on a New Zealand Passport are generally eligible for the Visa Waiver Program (VWP, which enables nationals of certain countries to travel to the United States for tourism or business (visitor visa purposes) for stays of 90 days or less without obtaining a visa. Please also check that your passport is undamaged, has blank pages and remains valid for at least six months after your planned return date or you could be denied boarding.

If your electronic travel authorization application is approved, it establishes that you are eligible to travel, but does not establish that you are admissible to the United States under the Visa Waiver Program. Upon arrival to the United States, you will still be inspected by a U.S. Customs and Border Protection Officer, at your first port of entry, who may determine that you are inadmissible under the Visa Waiver Program or for any reason under United States law. If you are not eligible for an electronic travel authorisation for any reason you will need to apply for a Visa.

Re-entry visas will/may be required for travellers leaving New Zealand holding a foreign passport. If you hold a foreign passport, then it is your responsibility to make your own enquiries and satisfy yourself as to the position regarding your passport and/or visa requirements before leaving New Zealand.

We strongly recommend you investigate the rules and regulations around entry visas, re-entry visa and/or applicable waivers prior to booking your travel, particularly if you have any concerns about whether you might be eligible for an ESTA.

  • Checking Your Travel Arrangements

We have exercised care in putting together the arrangements requested by you regarding your travel arrangements. It is important that you check all documentation handed to you to ensure that it fully meets with your requirements and to ensure that there have been no misunderstandings. 

It is your responsibility to ensure that all names in your booking are correct as per passports, and that all other details in your documentation are correct prior to confirming your booking with us. You may be denied boarding if the name varies in any way. We will not be liable for costs or losses in connection with incorrect names or details either provided to us by you, or that have been included in documentation from us that has been received by you prior to confirming your booking.  

  • Prices

All prices shown are in New Zealand Dollars unless explicitly noted otherwise. All prices are subject to availability and can be changed or withdrawn prior to acceptance and payment being made by you. Airfares and other prices offered by the Principals can increase with limited notice even though your arrangements have been confirmed (due to currency fluctuations, tax changes and for other reasons). Such price increases are beyond our control, and you will be liable to pay for any such increases. Many airlines now impose surcharges on the price of travel. These surcharges may change between the time you make a reservation and the date of full payment. You will be liable to pay for any increases in such surcharges.

  • Disclosure of financial arrangements

We may receive commissions, fees, or financial incentives from the sale of airfares and travel products and services on behalf of Principals.

  • Booking, Payment and Documentation

No booking instruction from you will be binding on us until we have confirmed the reservations to you.

Deposit 

We require a non-refundable Trip Planning deposit of $250 per person before we can proceed with any booking requests. Once you have paid this deposit, we will create the bookings we have agreed to make on your behalf. Our Trip Planning deposit is non-refundable and will be used as part payment of the total price of the bookings that we make on your behalf. The deposit amount may vary depending on any additional deposit requirements of our Principals.

Additional Payments
Payments that are due for certain items and/or final payment for the balance of your travel arrangement, as set out in our Confirmation Advice to you, must be made when due. Failure to do so may result in cancellation of your bookings by us or a Principal and no compensation will be payable. Additional cancellation fees may also be charged in accordance with these terms. Travel documents will not be issued until full payment in cleared funds is received by us.

How To Pay
Payments may be made via electronic bank transfer, credit card or debit card. Credit card surcharges will apply when you pay by credit card. In certain circumstances your credit card will be charged by the Principal. When your credit card is processed by us you agree, where the services have been provided, not to have your payment ‘charged back’ or reversed by your credit card provider.

Q Card is also an accepted forms of payment subject to lending and credit criteria being met, however additional fees and surcharges may apply. Please check with us for more details.

Documentation
Once we have received full cleared funds payment from you, tickets and documentation will be finalised and electronically delivered. 

  • Authority acknowledgement

By making payment for a booking made with us, you confirm you are authorised to deal with all matters in connection with the booking with us or Principals on behalf of all other travellers named in the booking confirmation. You also accept the terms and conditions as set out in the booking confirmation on behalf of all travellers, and that such authorisation will continue unless otherwise revoked in writing.

  • Travel USA Fees and Charges

Travel USA Trip Planning Deposit

A non-refundable Travel USA Trip Planning deposit of $250 per adult (18 years and over) must be made before we can proceed with any booking requests. Once you have paid this deposit, we will create the bookings we have agreed to make on your behalf. Our Trip Planning deposit is non-refundable and will be used as part payment of the total price of the bookings that we make on your behalf. 

Principal(s) Deposits

Additional deposits may also be required from our Principals before they will proceed with any booking requests we make on your behalf. The conditions around these will vary from Principal to Principal and will be shared with you at the time of booking.

Amendments

We understand that things change however if you wish to change a confirmed reservation, you are likely to incur fees. You should always check the cost before requesting changes in reservations.

Any changes after booking for any reason will incur a Travel USA Amendment Fee of $150 per passenger, per amendment, in addition to any amendment, re-issue or upgrade fees charged by our Principals. 

Cancellations

Cancellation fees will be incurred on all confirmed reservations or bookings. In some cases, it may not be possible to change reservations or to cancel the reservation or it may be uneconomic for you to do so. You should always check with us before you confirm arrangements and/or before you cancel any confirmed reservations for details.

Where travel arrangements are cancelled for any reason prior to full payment being made, any non-refundable deposits will be forfeited in addition to any cancellation fees levied by our Principals.

Where travel arrangements are cancelled for any reason after full payment has been received, a Travel USA Cancellation Fee equivalent to 10% of the total cost of your booking will be charged in addition to any cancellation fees levied by our Principals.  

  • Refunds

Where a refund is due this will be paid to you, less any applicable Cancellation Fees, once we have received the monies from the Principal involved. 

Your right to a refund is subject to the terms and conditions of the airfare or travel service provided by the Principals. We are not responsible for any delays by a Principal in processing a refund, which may take a significant time to be processed, and any payment of a refund to you is subject to us receiving it from a Principal.

  • Liability

To the extent permitted by law, we do not accept any liability for any loss or damage, injury, delay, inconvenience, loss of enjoyment or expenses caused directly or indirectly, by acts, omissions or default, whether by negligence or otherwise, by any Principal or by any other event beyond our control, including, without limitation, strikes, accidents, pandemics or outbreaks of infectious diseases, quarantine restriction, public health decree, state of emergency, acts of war or terrorism, civil or military disturbances, acts of God or where not preventable by our reasonable diligence.  Where our liability cannot be excluded and where our liability may be lawfully limited, then that liability will be limited to the remedies provided by law.

We strongly advise you to regularly check the Ministry of Foreign Affairs Travel Advisories at www.safetravel.govt.nz to assist you in accessing any risks prior to travel.

  • Changes to these terms and conditions

We may amend these terms and conditions at any time. The applicable terms and conditions are those in effect at the time you make a booking with us.

  • Governing Law and Enforcement

Any disputes you may have with Travel USA will be subject to New Zealand law and the jurisdiction of the New Zealand Courts. Principals and your contracts with them may be subject to different laws and jurisdictions. We note that international air transport conventions may apply in respect of the travel services in your booking. Any illegality, unenforceability, or invalidity of a provision of these Terms and Conditions does not affect the legality, enforceability, or validity of the remaining provisions.

  • Privacy Policy

We respect your privacy and will handle your private information only in accordance with our Privacy Policy which is available at www.travelusa.co.nz/privacy.

To facilitate your booking or to provide a travel recommendation we will need to collect relevant personal information from you and provide this to travel services suppliers and other entities. By proceeding you confirm consent from all named travellers to us processing and providing your personal information (which may include sensitive information) to these suppliers and entities as per our Privacy Policy for the purposes of fulfilling the booking, noting that because some travel services suppliers and facilitating entities are located outside New Zealand, they may not be required to protect your personal information in a way that, overall, provides comparable safeguards to those in New Zealand.

DECLARATION

On behalf of all travellers and the person making payment for the bookings, you confirm, by using our services and having us create bookings on your behalf, that you have read, understood, and accepted these Booking Terms and Conditions
